I hope this letter finds you well. I am writing to express a growing concern within our community regarding the adherence of the Board of Directors to our governing documents. As homeowners, we have entrusted the Board with the responsibility of managing our association in accordance with these documents to ensure transparency, fairness, and the overall well-being of our community.
Recently, homeowners, myself included, have experienced instances where Board actions appear to diverge from the established bylaws, covenants, conditions, and restrictions (CC&Rs) and Davis-Stirling laws that are meant to guide our community’s governance. Such deviations not only undermine the trust we place in our Board but also threaten the stability and harmony of our community. There have been instances where Board Members are telling homeowners to do something that our governing documents restrict. Has the Board even read all the Governing Documents so that they know all the CCR's Bylaws, etc? Reading all of them should be a requirement before starting their first day of serving on the Board.
In light of these concerns, we believe it is imperative for homeowners to come together and advocate for strict adherence to our governing documents. By doing so, we can help ensure that decisions made by the Board are in the best interest of all residents and in alignment with the rules and regulations that were agreed upon when we became members of this community.
To address this issue constructively, we propose the following actions:
1. Increased Transparency: We urge the Board to provide more detailed minutes of meetings and to make these documents readily accessible to all homeowners. Transparency in decision-making processes is crucial for maintaining trust.
2. Regular Review of Governing Documents: Establish a committee of homeowners to regularly review the governing documents and recommend necessary updates to ensure they remain relevant and comprehensive.
3. Open Forums for Discussion: Implement regular open forums where homeowners can voice their concerns and provide input on Board decisions. This will foster a collaborative environment and ensure that diverse perspectives are considered.
4. Education and Training: Encourage Board members to participate in training sessions on governance and adherence to legal and regulatory requirements. An informed Board is better equipped to make decisions that comply with our governing documents.
5. Accountability Measures: Develop clear procedures for addressing violations of the governing documents by the Board, including potential consequences for non-compliance. Accountability is key to ensuring that the Board operates within its legal and ethical boundaries.
We believe that these steps will help restore confidence in the Board’s leadership and ensure that our community remains a place where rules are respected and everyone’s interests are protected.
